Strength Index

A transparent way to assess what the facts presently support

The Vestal Analytics Strength Index converts a large and often fragmented record into a disciplined comparison of the facts available to each viewpoint. Each defined category is scored from 0 to 5 and multiplied by its approved weight.

Independent scores

Two positions, scored separately

The defense score and opposing-party score are calculated independently. They do not have to total 5. Both positions may be strong, both may be weak, or the record may remain incomplete.

Use the sample to the right to see how the Index responds as facts move from unknown to documented. The example is illustrative and does not reflect any client matter.

Method controls

How each control protects the analysis

Defined categories and weights
The categories reflect the central property and dispute questions. The weights are disclosed and may be reviewed with the client.
Source-based scoring
Material scores are tied to identified documents, data, testimony status, or clearly stated assumptions.
Missing-fact treatment
Unknown or unavailable facts are shown rather than silently treated as favorable to either side.
Independent party scores
The strength of one position is not mechanically calculated as the weakness of the other.
Sensitivity analysis
Alternative reasonable assumptions identify which facts change the result and which conclusions remain stable.
Update capability
Scores can be refreshed as offering materials/documents, communications, voting materials and ballots, expert reports, rulings, oversight findings or other partnership materials are added.
